Terms of Service

These Terms of Service ("Terms") govern your use of myCashery ("the Site") operated by ayeT-Studios GmbH, Lister Platz 2, 30163 Hannover, Germany ("we," "us," or "our"). By accessing or using the Site, you agree to be bound by these Terms. If you do not agree with any part of these Terms, you should not use the Site.

  1. Eligibility

    1. Age: The Site is available for individuals who are at least 16 years old. By accessing or using the Site, you represent and warrant that you meet this age requirement.
    2. Location: The Site may be limited to users residing in certain geographical locations. It is your responsibility to ensure that your use of the Site complies with any applicable laws or regulations in your jurisdiction.

  2. User Accounts

    1. Registration: In order to access certain features or participate in certain activities on the Site, you are required to create a user account. Only natural persons are allowed to register as users. You agree to provide accurate, current, and complete information during the registration process. When you register, you are presenting us with a legally binding offer to enter into a usage agreement. The user contract is finalized upon the confirmation of your registration and the activation of your user account.

    3. Account Termination: Each user may only register once. If multiple accounts are used or systematic use is detected, we reserve the right to block the accounts. We have the right to exclude you from using our services and delete your user account if we have reasonable grounds to believe that you have breached the material obligations under these Terms of Service. We will inform you about this exclusion and give you the opportunity to comment. We will take your legitimate interests into account and will consider to exchange your account balance for a payout or vouchers as long as the balance is above the minimum amount for withdrawals. The right to extraordinary termination remains unaffected.

  3. Earning and Redeeming Rewards

    1. Reward Activities: The Site may offer various activities through which you can earn rewards, such as completing surveys, participating in promotional offers, or referring new users. The availability and terms of these activities may vary and are subject to change at our discretion.
    2. Reward Currencies: Rewards are provided in the form of virtual currency. Even though you may see your account balance in “Cash”, it indicates a virtual currency and does not imply that you own this amount in the form of real money. The specific types and values of rewards for each offer or survey you complete will be clearly communicated on the Site.
    3. Reward Redemption: You may redeem your earned rewards in accordance with the rules and limitations specified on the Site. We reserve the right to modify or discontinue any rewards or redemption options at any time without prior notice.
    4. Taxes and Fees: You are solely responsible for any taxes, fees, or other charges associated with earning or redeeming rewards. It is your responsibility to comply with any applicable tax laws in your jurisdiction.

  4. User Conduct

    1. Prohibited Activities: You agree not to engage in any of the following activities in relation to the Site:
      • a) Violating any applicable laws, regulations, or third-party rights.
      • b) Posting or transmitting any content that is unlawful, harmful, defamatory, obscene, or otherwise objectionable.
      • c) Interfering with or disrupting the operation or security of the Site.
      • d) Engaging in any fraudulent or deceptive practices.
      • e) Accessing or attempting to access unauthorized areas of the Site or other users' accounts.
      • f) Using "bot-controlled" software, elements, apps, etc. in any form
      • g) Attempting to manipulate the earned amount of currency by modifying settings or network connection.
      • h) Sharing offensive, aggressive, violence-glorifying, or other legally prohibited expressions, sentences, or messages in the form of comments, images, or any other media related to the Site or in comments on platforms like the Google Play Store and other social media platforms such as Instagram, as well as any other form of communication.
      • i) Sharing the referral link to invite friends (Refer a Friend Program) in the comments (reviews) of the Google Play Store. The friend code should only be shared with friends or included in the user's own content on social media.
    2. Guarantees: You guarantee that you:
      • a) Are a natural person using a smartphone or tablet.
      • b) Are at least 16 years old. Accurate information must be provided. Providing false information will lead to account blocking and deletion.
      • c) Are using only one device on the Site and that you are not systematically use the Site with multiple devices.
      • d) Are using the Site only in your home country. The use of services like fake GPS, VPN, or similar tools while using the Site is not allowed.
      • e) Are earning the on-site currency only through approved methods provided on the Site. These methods include watching videos, completing offers from offerwalls, or participating in surveys.
    3. Failure to comply with these rules and restrictions will result in strict sanctions, including account deletion, resetting of the unearned Currency, and withholding of rewards obtained through prohibited means.

  5. Intellectual Property

    1. Ownership: The Site and its content, including but not limited to text, graphics, images, logos, and software, are owned by or licensed to us and are protected by intellectual property laws. You agree not to use, reproduce, modify, or distribute any content from the Site without our prior written consent.

  6. Disclaimer of Warranties

    1. Site "as is": The Site is provided on an "as is" and "as available" basis. We make no representations or warranties of any kind, whether express or implied, regarding the operation or availability of the Site.
    2. Third-Party Content: The Site may include links or references to third-party websites or content. We do not endorse, control, or assume any responsibility for such third-party materials.

  7. Limitation of Liability

    1. Exclusion of Damages: To the fullest extent permitted by applicable law, we shall not be liable for any direct, indirect, incidental, consequential, or punitive damages arising out of or in connection with your use of the Site or these Terms.
    2. Limitation of Liability: In no event shall our total liability to you for all damages, losses, or causes of action exceed the amount paid by you, if any, for accessing or using the Site.

    2. Jurisdiction: Any dispute arising out of or in connection with these Terms shall be subject to the exclusive jurisdiction of the courts located in Hannover, Germany.

    1. Entire Agreement: These Terms constitute the entire agreement between you and us regarding the subject matter herein and supersede all prior or contemporaneous communications and proposals, whether oral or written.
    2. Severability: If any provision of these Terms is held to be invalid or unenforceable, the remaining provisions shall continue in full force and effect.
    3. Waiver: Our failure to enforce any right or provision of these Terms shall not be deemed a waiver of such right or provision.
